Terms of Use Agreement for the Ceda FX Signals Mobile Application
This Terms of Use Agreement (“Agreement”) sets forth the legally binding terms and conditions for your use of the Ceda FX Signals mobile application (“Application”), which is owned and operated by Ceda FX Signals (“CEDA”, “we”, “us”, or “our”). By registering for and using the Application, you agree to be bound by this Agreement and all of the terms and conditions herein.
- User Information Collection
When you register for the Application, we collect your name, surname, email address, phone number, and a password to create your account. Additionally, while you use the Application, we collect your IP address, device brand, model, operating system, and mobile network operator.
We use your IP address to determine your location, which we use to display the Application’s content according to the local time zone. We use your device brand, model, operating system, and mobile network operator to measure statistics and assess the Application’s performance.
Your personal information, such as name, surname, phone number, email address, and password, is stored in our database in encrypted form. We use specialized software technologies to ensure the confidentiality of user data and take all necessary cyber-security measures to prevent data breaches.
We may share the collected data with third-party service providers for statistical, advertising, and marketing purposes, subject to appropriate conditions and approval.
- User Obligations
By registering for the Application, you represent and warrant that:
- You are at least 18 years of age and capable of entering into a binding agreement.
- The personal information you provide during registration is accurate, current, and complete.
- You will keep your login credentials, including your password, confidential and secure.
- You will not use the Application to violate any applicable laws or regulations, including but not limited to, those related to intellectual property, privacy, and security.
- You will not use the Application to transmit any spam, viruses, or other malicious content.
- Intellectual Property
Ceda FX Signals owns all intellectual property rights related to the Application. You acknowledge and agree that the Application, including but not limited to its design, graphics, text, sounds, and other materials, are protected by copyright, trademark, and other laws.
You may use the Application solely for your personal and non-commercial use. You may not modify, reproduce, distribute, transmit, display, or create derivative works based on the Application, in whole or in part, without our prior written consent.
- Termination
We may terminate this Agreement and your access to the Application at any time without notice or liability. Upon termination, you must immediately cease all use of the Application.
- Disclaimer of Warranties
The Application is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that the Application will meet your requirements or that the Application will be uninterrupted or error-free. You use the Application at your own risk.
- Limitation of Liability
In no event shall Ceda FX Signals be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Application, even if we have been advised of the possibility of such damages.
- Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any dispute arising out of or in connection with this Agreement shall be resolved through arbitration in accordance with the rules of the International Chamber of Commerce (ICC). The arbitration shall be conducted in Turkish, and the arbitration award shall be final and binding.
- Modifications to Agreement
Ceda FX Signals reserves the right to modify this agreement at any time without prior notice. The user’s continued use of the mobile application after any changes to this agreement constitutes acceptance of those changes.
- Disclaimer of Warranties and Limitation of Liability
The mobile application and its contents are provided on an “as is” and “as available” basis. Ceda FX Signals makes no representations or warranties of any kind, express or implied, as to the operation of the mobile application or the information, content, materials, or products included in it. To the fullest extent permissible by applicable law, Ceda FX Signals disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. Ceda FX Signals will not be liable for any damages of any kind arising from the use of the mobile application, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
- Indemnification
The user agrees to indemnify and hold Ceda FX Signals, its affiliates, officers, agents, employees, and partners harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of the user’s use of the mobile application, violation of this agreement, or violation of any rights of another.
- Governing Law and Jurisdiction
This agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey, without giving effect to any principles of conflicts of law. Any dispute arising out of or in connection with this agreement shall be submitted to the exclusive jurisdiction of the courts of Istanbul, Turkey.
- Entire Agreement
This agreement constitutes the entire agreement between the user and Ceda FX Signals regarding the use of the mobile application and supersedes all prior agreements and understandings, whether written or oral, regarding such use.
- Termination
Ceda FX Signals may terminate the user’s access to the mobile application at any time, with or without cause, with or without notice, effective immediately. If the user wishes to terminate this agreement, they may simply discontinue using the mobile application.
- Waiver and Severability of Terms
The failure of Ceda FX Signals to exercise or enforce any right or provision of this agreement shall not constitute a waiver of such right or provision. If any provision of this agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of this agreement remain in full force and effect.
- Assignment
This agreement and any rights and licenses granted hereunder may not be transferred or assigned by the user, but may be assigned by Ceda FX Signals without restriction.
